Template for Agreement between Advocate and Client/Litigant (for Pro Bono cases)

July 18, 2022 by videv

Below is a template for agreement regarding communication and other modalities between an Advocate (on Vakalatnama) and Client/Litigant. The following is just an indicative template, and it is only meant for educational purpose.  Kindly do not post any comment asking for name or contact of said advocate. Since the below template is for Pro Bono (where advocate does not charge fees to client, but do read the details regarding other legal expenses etc), the agreement template will need to be modified regarding services and expectations when it is on a paid basis. Even if you are unable to get a written agreement like below, it is recommended to go through all the points and come up with an implied agreement preferably through communication via WhatsApp, Email, SMS as may happen over … [Read more...] about Template for Agreement between Advocate and Client/Litigant (for Pro Bono cases)

How to file FIR or Complaint if police refuses to register it?

May 24, 2020 by videv

One of the common refrain or complaint of public is that even if they go to police station to report about some crime, they will be sent back and their complaint or FIR will not be registered. In matrimonial related cases, it has been seen that any complaint by wife is taken and registered into an FIR easily, whereas any complaint or FIR by husband is taken only if there are visible injuries or blood on him!  I have seen one such case where FIR under IPC Section 323 was registered on in-laws party due to a bleeding head injury inflicted on husband.  On the other hand, recently there were circulated on Twitter photos of a man with visible injuries on his head along with blood streaking down, but police has refused to register an FIR! Sending husband back is probably the more … [Read more...] about How to file FIR or Complaint if police refuses to register it?

Complaint against male abuse in Asian Paints Damp Proof advertisement -advertiser advised by ASCI to modify or remove it

May 14, 2020 by videv

People who had complained to Advertising Standards Council of India (ASCI) against Asian Paints Damp Proof Advertisement at this youtube link have received final confirmation email from ASCI that their complaint has been upheld. While there is good likelihood that the advertisement will be modified or removed, but one should also read the fine print which says that the role of ASCI in the matter is of persuasion to advertisers, and it is not mandatory that the advertiser has to follow the advice given by ASCI.  Basically, ASCI is a self-regulatory body and not a governmental organisation. Need for public disclosure about the advertisement and the problems in it: The advertisement is available on YouTube and is meant for public view.  The complaint against the advertisement is also … [Read more...] about Complaint against male abuse in Asian Paints Damp Proof advertisement -advertiser advised by ASCI to modify or remove it

How to file complaint against anti-male, anti-men, anti-boys advertisements to Advertising Standards Council of India?

April 5, 2020 by videv

From time to time, the corporate businesses keep coming up with anti-male advertisements, and both these advertisers and the ‘creative’ agencies behind it are doing it with much glee – hoping that more and more males will be only be too eager to embrace the neutering of their masculinity and pride in any male accomplishment.  This is because the zeitgeist demands that any middle or upper-middle class male must compete in this race downhill to mock and demean other ‘samples’ of failed manhood – to gain approval of the rising gynocracy in society, to show their support towards fake feminism, and to increase their women empowerment credentials – because those are fast becoming the means to achieve higher status in society. Usually, such anti-male advertisements, be it regarding a detergent … [Read more...] about How to file complaint against anti-male, anti-men, anti-boys advertisements to Advertising Standards Council of India?

How to search, find, and download electronic copy of FIR uploaded by Police?

April 29, 2019 by videv

This post will give links to various websites of State police departments in India, where one can find FIR and download a copy.  Note: these are NOT about filing an FIR (First Information Report), but only to find and download electronic copy of an already existing FIR which has been uploaded by respective state’s police. The direction to upload copy of FIRs came about due to this judgment by Supreme Court in 2016, the main intention being to protect rights of the accused who by law (CrPC) could not get copy of FIR until filing of charge-sheet by police in court.  Now, by having access to online FIR, the accused can easily get the FIR copy (without paying bribes etc), and start preparing for investigation, or defence before impending trial.     How to use the … [Read more...] about How to search, find, and download electronic copy of FIR uploaded by Police?

How to complain against judges of trial courts, High Courts, and Supreme Court?

May 4, 2017 by videv

This post is about how to complain against any judge be it trial courts, high courts, or supreme court in India.  Right now it is being written with information collected from various places and based on personal experiences of people, and over time will have authoritative information.  This post however does not cover about bad or unbecoming conduct of a judge outside of a court or trial scenario. Complain against judge cannot solely be because of a ‘bad’ judgment or order which has gone against you.  Remember that in every interim order/final judgment one of the two opposing parties may not like the order.  But that by itself doesn't become of a case of complaint against judge, because judge may have followed the law and appreciated the evidence and no bias or misconduct may be proven … [Read more...] about How to complain against judges of trial courts, High Courts, and Supreme Court?
