Recently someone sent email via our NGO website and upon my reply to his email giving some basic advice and further suggestion to join our groups, he replied back asking with a profound question, which triggered the need for writing this article. His full email had only one sentence: “ok thank u but is there no law which supports men can police help”. As an aside, I am unable to understand why do some people (though it has come down a lot) reply to my email asking a further question ignoring the standard large sized red coloured matter at the end of my every email: “I will not reply to personal emails for advice in future. Lot of the time people who are facing false cases -- be it IPC 498A, false domestic violence allegations under DV Act, -- tend to make a demand to lawmakers and political leaders, that a provision of law misuse must be added to so and so Act, e.g. add misuse clause to IPC 498A, or add misuse clause to rape law to punish women making false rape complaints. All those demands are from made with good intentions, but there is a saying: “the road to hell is paved with good intentions”. FIR against wife for alleged bid to extort money from husband by threat of false dowry 498A case
Breaking news! An FIR has been registered by suburban Kandivali police against a woman today for allegedly cheating, trying to extort money, reneging on her divorce agreement as well as threatening to file a false dowry case against her husband. Case has been registered against two of the woman's close relatives also. According to the case which was filed on April 9, the police has charged the accused persons under Section 385 (extortion), Section 420 (cheating) and Section 34 (common intention) of the Indian Penal Code. Why Indian men should be very careful in filing divorce
To better understand some of the terminology and context used in this post, reading some of the important posts is recommended. Now this post will cover the majority of cases of calls and issues received by men’s rights activists (MRAs) all over India. Almost 80-90% of callers have been into very short marriages, anywhere from 1 year to 3 years where the time wife was in same home as husband maybe anywhere from few weeks, few months, or maximum maybe 1.5 years or so. Innocent until proven guilty is the law, use it
There is a saying that Ignorance of the law is not an excuse. For example, you can’t just forget to file your income tax return and then claim that you were unaware that it applies to you. It is applicable in criminal law too. A bigger principle possibly could be: knowledge of the law can be a very beneficial thing! Going back to income tax example, only those who know the latest intricacies of income tax law will be able to utilize it’s full potential to minimize tax outgo by using exemptions on investments, rebates etc etc. And corporates have to know the law fully well to be able to operate.
