After the 2013-14 episode of a law intern’s sexual harassment complaint against ex-Justice A K Ganguly which didn’t go anywhere because probably it was never meant to, we have one more sexual harassment/molestation complaint against a well known person. Delhi Police FIR against R K Pachauri on charges of sexual harassment TERI chief R K Pachauri , who received the Nobel in 2007 on behalf of an international panel on climate change, has been named in an FIR lodged in New Delhi by a woman colleague who has accused him of sexual harassment. … In the FIR, the complainant, who works at the D-G’s office in TERI, claimed that Pachauri had sexually harassed her for nearly two years since she joined the organisation in September 2013. She also alleged that Pachauri had engaged in “sexually … [Read more...] about TERI chief Dr R K Pachauri faces IPC 354, 354A, 354D, 506; media trial starts now
How to file objections/written statement to wife’s DV/CrPC 125/divorce etc petition
The standard thing that needs to be done when husbands get summons from court in maintenance/DV case is to file objections. Ok, some people may say that the judge will send the case to mediation first, but the useless drama that goes by mediation is the subject of another post later. So here I provide very simple way how to write the objections for each statement in wife’s petition. It is always advised to write your own and send it to advocate for taking print and filing in court. Because even though wives are allowed to tell lies and rampant contradictions, higher standards may get applied to statements made by respondent husbands. The standard way is like this: Wife's petition says: In the XYZ court between Maharani … [Read more...] about How to file objections/written statement to wife’s DV/CrPC 125/divorce etc petition
Understanding the divorce industry in India
On Oct 26, 2014, Navodaya times (part of Punjab Kesari group) had published my interview as part of their Purush Shakti feature. The headline of the interview was titled as “All is well with the ongoing divorce industry”. As far as I know, this is the first time a media article has acknowledged the words divorce industry in an article headline, or probably even in body of the story. Now question may be asked that what is this animal called divorce industry, and whether it is justifiable to call something unfortunate as divorce as part of any industry? Is divorce really cool? Firstly, let me clarify that I don’t believe in the ‘cool thesis’ being put forth these days especially in mainstream western media that divorce can be good or healthy. The people who put … [Read more...] about Understanding the divorce industry in India

How to handle allegation of impotence by wife
Allegation in false cases by wives that “my husband is impotent” is not a new weapon, but it seems to be getting very common these days. So I thought to write a post solely on this topic. Typically this allegation will be made in a petition filed under DV Act (domestic violence) by wife. But it is very much possible that such an allegation may be made under CrPC 125 or even IPC 498A. Because usually when the 498A/DV women start to think what to file in complaint, they are ‘ably’ assisted by ‘learned’ lawyers (read any online lawyers forum) who ‘advise’ them to file complaint under so and so section, and so on. If you are the respondent husband or accused with such allegation made against you, the whole strategy has to be completely changed from here on. Medical definition of … [Read more...] about How to handle allegation of impotence by wife
How to assess maintenance amount likely to be ordered in CrPC 125 or HMA 24
This is a perennial question asked by men facing marital issues and one of these maintenance cases: CrPC 125 Sec 24 of Hindu Marriage Act (HMA 24) Maintenance asked in petition filed under DV Act (the maintenance proceedings run under CrPC 125) It seems no amount of replies as to how it will be calculated is enough. Maybe when the mind gets into an obsessive mode thinking about something, it asks the same thing again and again no matter how many answers anyone else can provide, be they laymen or experts it doesn’t matter much! So instead of attempting to give an answer it, I have decided to post some useful judgments where maintenance was decided seemingly in an objective manner based on data presented in front of judges by both husband and wife. So this should be simple homework on … [Read more...] about How to assess maintenance amount likely to be ordered in CrPC 125 or HMA 24
