Since the law commission has recently asked for suggestions and comments on a shared parenting consultation paper, I am listing down some points based on my understanding of law, it’s practice, and actual scenario for fathers in Indian family courts. Update 3-Mar-2015: There was some news that government may drop marriage amendment bill (which introduces Irretrievable Breakdown of Marriage OR IrBM clause), but we cannot be too sure since there seems to be an inexplicable urge behind this bill, presumably to appease the international media that India is not just a women oppressive regime, or a rape and gang-rape country. It’s another matter that rape and other crime statistics are much higher in these developed countries who report the crimes in India. Proposed private bill for 40% or more maintenance to abandoned wives
Some MRAs have discovered that apart from IrBM (Irretrievable breakdown of marriage) bill which got passed in Rajya Sabha (but not Lok Sabha) during UPA rule, a new private bill is waiting to be introduced for discussion in Lok Sabha. The bill proposes to define a category called abandoned wives and proposes to give maintenance not less than 40% of husbands’ income to such wives. Update 20 Nov 2014: According to latest news, the marriage amendment (2010) bill which was passed during UPA regime in 2013 in Rajya Sabha is now being resurrected and hurriedly being re-introduced in Winter session of Parliament starting on 24th Nov 2014.
