Update 3-Mar-2015: There was some news that government may drop marriage amendment bill (which introduces Irretrievable Breakdown of Marriage OR IrBM clause), but we cannot be too sure since there seems to be an inexplicable urge behind this bill, presumably to appease the international media that India is not just a women oppressive regime, or a rape and gang-rape country.  It’s another matter that rape and other crime statistics are much higher in these developed countries who report the crimes in India.

According to latest news, the marriage laws amendment (2010) bill which was passed during UPA regime in 2013 in Rajya Sabha is now being resurrected and hurriedly being re-introduced in Winter session of Parliament starting on 24th Nov 2014. The bill allows wife to get divorce and also lay a claim on on dear husband’s property after merely staying separately for 3 years.

I came across a newspaper report that the “Marriage Law (Amendment) Bill, 2010” will be brought in the Winter Session.  This is a lapsed UPA bill. This bill was drastically different from the version brought by the Joint select Committee. Why  are parliamentary process not being followed.

Repealing obsolete laws is good. At the same time, faulty laws also shouldn’t be framed. This is a Sonia Raj bill. We really want a Modi Sarkar bill as we expect good governance and transparency from you. A draft must be made public and opinion be sought before presenting on the table of Lok Sabha.

This bill affects millions and will be disastrous if you allow it to be passed in the UPA form. We have high hopes. We will work with you for building a Shrest Bharat. Please don’t follow the Congress way.

Respected Modi Sir,

Having realised that Marriage Law ( Amendment ) bill via news channels and media houses i am surprised to see the same old steps by UPA being followed by Modi Sarkar as well.

Firstly to see known parliamentary process not being followed is worrisome.

This bill is drastically different from the version brought by the Joint select Committee which was constituted after SC requested for it , interesting to not that did not have property details in it. UPA included it and seems like BJP is taking it forward.

This is giving a reason to believe we are about to see the same format of governance as UPA. Please put this bill in public domain for discussion and then take a constructive approach before being presented in Lok Sabha.

This affects millions of law abiding citizens and will be disastrous if you allow it to be passed in the UPA form without due process, examples of which we have seen to be detrimental to India in the previous decade and do not expect the same from Modi Sarkar.

With this letter, we hereby want to register very serious and strong objection to the process followed for the Introduction of Marriage (Amendment) Bill.

As per the latest news reports and as per our phone calls to the Legislative Department of Law Ministry, it is understood that the Government is about to Introduce a new Law, Marriage (Amendment) Bill in this Winter Session. The draft bill is to change Hindu Marriage Act, 1955 and Special Marriage Act.

With this Letter, we hereby request to you for:

1. Immediately, stop the process of the current Marriage (Amendment) Bill as it violates Fundamental Rights of Citizens in a Democracy.

2. Issue the Draft for Public Opinion and responses on the Draft Bill.

3. Involve Stake holders of similar stature in drafting procedure i.e. if there are no Men’s Rights Authority (like National Commission of Men) who are part of drafting then even Ministry of Women and Child Development and National Commission of Women MUST not be allowed to participate in this procedure.

4. Initiate the process of formation of National Commission of Men involving bodies who have been working for Men for years to bring the equitable balance back into the society in terms of Laws and Law Making process.

5. Initiate a Parliamentary Committee procedure to relook at the Draft and see if there is a Need of such a law and if it is as per the Guidelines of Hon’ble Supreme Court or being formed under pressure of some interested parties.

Looking forward to your kind help and support and immediate action as per this letter.

– Husband can not oppose the divorce.
– Husband’s assets are only shared. Wife’s assets ignored.
– Marriage duration is not considered. The wife can force the husband to part with more than 50% of
his premarital, acquired and share in ancestral, inheritable assets even for a 1-day marriage.
– Wife’s earnings, education is not considered.
– Husband would still be running around the courts fighting the false cases (498a, DV, CrPC125 etc)
while the wife would get the divorce and may marry another man to continue the extortion.
 
It appears more like the husband is being punished for a “No Fault” divorce. The state is sponsoring
this extortion. Women’s empowerment need not be achieved by suppressing men. Why not make it gender
neutral by replacing husband/wife with spouse? The right to oppose should be given to both.
 
With a new Lok Sabha, the draft of the bill should be made public. Opinion should be sought from all,
including from NGOs run by men, as it affects millions before it can be tabled in the Lok Sabha. We
have high hopes on you as we expect good governance and transparency.
 
Please don’t rush to pass this bill as many factors were ignored. Let a proper parliamentary process
be followed.  Proper debate should be conducted. A majority of MPs should be present while passing
laws which have far reaching ramifications.
 
This bill affects millions and will be disastrous if you allow it to be passed in the UPA form. We have
high hopes. We will work with you for building a Shrest Bharat. Please don’t follow the Congress way.
 
Hopefully you will consider the common man’s suggestion and inputs in policy making unlike the Congress.

We didn’t expect that the lapsed UPA bill will be presented by a Modi Sarkar.
Do you want to be remembered in Indian history for unleashing a draconian law which
will destroy India? Please follow proper parliamentary process. Please have the draft
in public domain, solicit opinions from all stake-holders and then table it in Lok Sabha.
Please have a proper debate and a majority of MPs should be present while passing
laws which have far reaching ramifications.
 
Any MP who supports this law will support the destruction of families and the end of
the Hindu family system as we know it.
 
• This bill seeks to annex the hard earned of the property owned by the husband before
the marriage and his ancestral property at the time of divorce acquired without
any contribution of the wife. This will incentivize divorces and rate of divorces will

skyrocket.

 

• The education, earnings and assets of the wife is not taken into consideration.

• The duration of the marriage is ignored. A husband can be destroyed even for a
1 day marriage.

• This biased treatment accorded to men in marriages, for no fault of theirs, and such
victimization of men will lead to rise in crime in the society and husbands becoming
criminals.
 
• This bill also stands to deny husbands the chance to oppose a petition of divorce
filed by wife under this law, whereas an equivalent power wrests with the wife. Husbands
and wives are provided equal rights under article 14 of the constitution and hence this law is
unconstitutional.
 
• This bill does not guarantee unlimited access of a man towards his children.
 
• This bill does not provide even a semblance of immunity to a man from other legal
provisions surrounding marriage i.e. it does not bar a wife from filing a case of cruelty
against the husband under section 498A / Domestic Violence against the husband while
she seeks to obtain a decree of no-fault divorce.
 
• This bill can literally render a man bankrupt as he will first be extorted by the police
under a false case of 498A IPC, then the wife will file a case under the Domestic Violence
Act and seek maintenance, custody of children and right to residence, then again she
can still go ahead and file a case under Section 125 CrPC to seek additional no-fault
maintenance and after all this she will still be guaranteed ownership of at least 50% of
husband’s property or an amount equivalent to it.
 
• The extremely anti-male nature of the Indian judiciary puts the Indian men at a position
far precarious than one’s imagination as the judges, who are highly insensitive towards
men, will first give away at least 50% of the husband’s property to wife and then slap
additional maintenance, alimony and child support burdens onto the husband.
 
• In such a case a man will go bankrupt honoring court orders and paying litigation fees
and he will lose his property as well.
 
We have high hopes from you as we expect good governance and transparency. Hope you
will consider common man’s suggestions and inputs in policy making unlike the Congress.
We will work with you for a Shrest Bharat. Please don’t burden us with faulty laws.

Respected PM Sir,

The IRBM Bill in current form has many provisions which are highly prone to major misuse. Those will become Base for broken marriages and increased litigation because of money minded and greedy people in the society. All laws should be made unconditionally gender unbiased.

Draft of the bill is not according to select joint comitee report. With new Lok Sabha, first the draft must be made public and opinion be sought before presenting in on the table of LS.

The NDA govt is believed to be transparent unlike UPA in their tenure.

The Hindu succession act gives property to women from her parents. Why she should have any “forced” inheritance or consideration of inheritance from in-laws in case of opting for divorce after 2 days of marriage? This is purely illogical and unjust.

Original bill that was proposed on SC guidelines did not have it.  Even the joint select committee after public hearing never recommended parents property to be part of it.
Overall property built by couple after marriage should only be considered for sharing in case of divorce. And that even based on the individual’s contribution into shared property. Else you will see all big business families (ambanis, godrej, birlas, premji etc) sitting on the verge of divorce. People will stop working as any day their hard earned money can be snatched by wife and govt.

It will be counter productive to your people led growth and development agenda which is your mission for better India.

We humbly request you to let this bill go thru public opinions,  debates with support by facts and figures before presenting it for passing in LS.

We expect positive response from you on our request and justified demand for a society with equality,  harmony and justice.

Letters against IrBM, marriage amendment bill in Hindi

Letter 1

विषय: विवाह संशोधन विधेयक-२०१४ से सम्बन्धित गम्भीर आपत्ति
विवाह संशोधन विधेयक-२०१४ से भारतवर्ष को गम्भीर परिणाम भुगतने पड़ सकते है। भारत सरकार का “श्रेष्ठ भारत”, “Make In India” एव “सबका साथ-सबका विकास”का स्वप्न इस असंवैधानिक विधेयक से धूमिल हो सकता है। सुशासन की शुरुआत अच्छी तरह से सोच समझकर बनाये गये कानूनो से होती है। क्रपया UPA  सरकार के द्वारा लाये गये इस असंवैधानिक विधेयक को जल्दबाजी मे पारित न करे।
सुशासन हेतु मुख्यत सरकार को वर्षों से न्यायालयो मे लम्बित मुकदमो के निस्तारण पर ध्यान देना चाहिये, वर्तमान मे देश के उच्च न्यायालयो मे 43 लाख तथा अधीनस्थ निचली अदालतों में लगभग 3 करोड़ मुक़दमें लंबित हैं| विलंबित न्याय कदाचित् ही पीड़ित के लिए उपयोगी होता है।
न्यायिक व पुलिस व्यवस्था को सुधार की नितांत आवश्यकता है, जिसके फलस्वरूप लंबित मुकदमों का न्यायोचित व समयबद्ध रूप से निस्तारण संभव हो सकेगा, साथ ही यह भी आवश्यक है की ग़लत क़ानून न बनाए जाएँ, अन्यथा क़ानून के दुरुपयोग से झूठे मुक़दमों का बोझ देश की न्यायपालिका पर पुर्वरुप से बढ़ता ही रहेगा| 
विवाह संशोधन विधेयक भी एक इसी प्रकार का ग़लत व चूका हुआ विधेयक है, जिसके दुरुपयोग की संभावना अत्यधिक है| जिसको राष्‍ट्रीय जनतांत्रिक गठबंधन (NDA) सरकार पारित करना चाहती है| यह वर्तमान स्वरूप में संसदीय समिति द्वारा अनुमोदित विधेयक से सर्वथा भिन्न है एवम अनेकों कारणों का समावेश नहीं करता है|
यदि प्रस्तावित विवाह संशोधन विधेयक को पारित किया जाता है तो इससे शासन समर्थित लूट-खसोट को बढ़ावा मिलेगा, क्यूंकी इसमें बिना ग़लती के पति को तलाक़ का अकारण ही दंश झेलना पड़ेगा| BJP के इस कार्य से पूर्व में ही बनाए गये क़ानूनों के दुरुपयोग से जनित झूठे मुक़दमों की संख्या में बढ़ोत्तरी होगी तथा भारतीय सामाजिक एवं परिवार व्यवस्था पर गंभीर परिणाम होंगे| सभी नारी सशक्तिकरण के समर्थन में आपके साथ हैं, परंतु पुरुष के अधिकारों का दमन करके नारी के सशक्तिकरण से समाज में लैंगिक विषमता को बढ़ावा मिलेगा|

प्रस्तावित विवाह संशोधन विधेयक में मौजूद दोष:

१. विधेयक साफ तौर पर भारतीय संविधान के अनुच्छेद 15 का उल्लंघन करता है, जिसके अनुसार किसी भी नागरिक को धर्म अथवा लिंग के आधार पर भेदभाव को प्रतिबंधित किया गया है| विधेयक असंवैधानिक इसीलिए भी है क्योंकि यह पति को विवाह को अंतिम रूप से बचाने के अधिकार का भी हनन करता है एवम इस अधिकार को पूर्ण रूप से पत्नी को प्रदान करता है|
२. प्रस्तावित विधेयक में पत्नी का विवाहोपरांत परिवार के प्रति वैवाहिक योगदान, शैक्षिक योग्यता, अर्जित संपत्ति, विवाह की अवधि तथा पति के परिवार के प्रति दायित्व व धनार्जन की क्षमता की उपेक्षा की गई है|
३. वर्तमान हिन्दू उत्तराधिकार अधिनियम के अनुसार हर स्त्री को अपने नैसर्गिक माता-पिता की संपत्ति में से हिस्से का अधिकार प्राप्त है, ऐसे में उसको अपने ससुराल पक्ष से भी संपत्ति में हिस्से का प्रावधान कहाँ तक, तर्कसंगत है? साथ ही यदि किसी वरिष्ठ नागरिक द्वारा जीवन यापन हेतु अर्जित संपत्ति का उसके पुत्र के असफल विवाह की स्थिति में विभाजन कहाँ तक सराहनीय है?
४. इस विधेयक के अंतर्गत स्त्री को तलाक़ रोकने का तब तक पूर्ण अधिकार रहेगा, जब तक उसकी “आर्थिक माँगें” पति व उसके परिवारजन द्वारा पूरी ना की जाएँ, इसके परिणामस्वरूप क़ानूनी रूप से लूट-खसोट को बढ़ावा मिलेगा|
५. इस विधेयक में आर्थिक सहायता का प्रावधान सिर्फ़ स्त्री तक ही सीमित रखा गया है, जबकि कई बार तलाक़ की स्थिति में पति को भी ग़रीब श्रेणी से पाया गया है, ऐसे में बेचारे पति के पास सिर्फ़ आत्महत्या ही आख़िरी रास्ता बचेगा|
६. इस प्रस्तावित संशोधन के फलस्वरूप आपसी रज़ामंदी से वैवाहिक मतभेदों के निस्तारण के बजाय पति पर “आर्थिक बोझ” डालकर तलाक़ लेने का दवाब रहेगा, जिससे विवाह जैसा पवित्र रिश्ता एक जूट-खसोट का माध्यम बन कर रह जाएगा|
७. भारत सरकार के अनुसार, जहाँ 80% जनसंख्या को खाद्या सुरक्षा क़ानून की आवश्यकता है, जिसमें पुरुष व स्त्री दोनो ही शामिल हैं| ऐसे में इस विधेयक के कारण समाज में लैंगिक विषमता का जनन होगा|

प्रस्तावित विवाह संशोधन विधेयक के संभावित दुष्परिणाम:

१) भारतीय परिवारिक व वैवाहिक संबंधों में कमी:
– भारतीय परिप्रेक्षय में विवाह एक पवितरा रिश्ता ना होकर, सिर्फ़ एक संपत्ति हड़पने का माध्यम बन कर रह जाएगा|
– तलाक़ की स्थिति में स्त्री को मिला आर्थिक मुआवज़ा/ संपत्ति एक प्रोत्साहन का कारया करेगा एवम विपरीत-दहेज़ का कार्य करेगा, जिससे महिलायें परिवार व बच्चों के लिए नहीं बल्कि संपत्ति के लोभ में विवाह संबंध बनएँगी|
२) सामाजिक विषमताओं एवम गंभीर हिंसा की घटनाओं में व्रध्दि:
– संपत्ति अर्जित करने में वर्षों की कड़ी मेहनत लगती है, ऐसे मैं असफल विवाह की स्थिति में अकारण ही संपत्ति का विभाजन कहाँ तक उचित है?
– असफल विवाह की स्थिति में पति आत्महत्या पर मजबूर होंगे, राष्ट्रीय अपराध लेखा संस्थान के अनुसार वर्ष 2013 में 65000 पुरुषों ने आत्महत्या की, जिसमें प्रमुख कारण परिवारिक समस्यएं दी गई हैं. जबकि 30000 महिलाओं ने आत्महत्या की, जिससे वीदित है की पुरुषो में परिवारिक कलह मुख्या कारण है| इस नये विधेयक के कारण इस संख्या में व्रध्दि ही होगी|
३) भारतीय अर्थव्यवस्था व विदेशी निवेश हेतु प्रतिकूल माहौल:
– हिंदू परिवार संपत्ति अर्जन करने में विश्वांस नहीं रखेंगे, व समाज में भोग-विलास को बढ़ावा मिलेगा, जिससे अपराध दर में व्रध्दि आएगी|
– लोग सोना इत्यादि जैसी अचल संपत्ति में निवेश करेंगे, एवम काले धन को बढ़ावा मिलेगा|
४) हिंदू धर्म से अन्या धर्मों में धर्मांतरण को बढावा:
– असफल विवाह की स्थिति में हिंदू पुरुष स्वयं तथा अर्जित संपत्ति को बचाने हेतु अन्य धर्मों में धर्मन्तरित पर विवश होंगे, जिससे गंभीर सामाजिक, राजनीतिक व धार्मिक विसंगतियाँ उत्पन्न होंगी|
५) भारतीय न्यायपालिका में लंबित मुक़दमों की संख्या में व्रध्दि:
– अपनी संपत्ति को बचाने हेतु पति व परिवारजन लंबे समय तक मुक़दमों को लड़ेंगे, जिससे पहले से ही लचर न्यायपालिका पर अनावश्यक मुक़दमों का बोझ बढ़ जाएगा|
– भारत एआक ऐसा देश है, जहाँ 60% जनसंख्या 35 वर्ष से कम की है, तथा वैवाहिक मतभेद भी इसी उम्र में उत्पन्न होती है| यदि इस उम्र-वर्ग को परिवार व वैवाहिक संबंध अच्छे ना रहे, तो भारत की उत्पादकता निश्चित रूप से गिरेगी, क्यूंकी अधिकाँशतः युवा वर्ग मुक़दमेबाजी में अपना समय व उत्पादकता नष्ट कर रही होगी|
इस प्रकार से इस अपरिपक्व विधेयक को प्रस्तावित या पारित करना शासन की एक गंभीर भूल होगी एवम देश में सामाजिक व आर्थिक रूप से प्रतिकूल प्रभाव देखे जाएँगे| इस से “सबका साथ-सबका विकास” जैसे भारत सरकार के स्वप्न सिर्फ़ दिवास्वप्न ही बन जाएँगे|
आपसे अनुरोध है पुरुषों के लिए कार्यरत समाजसेवी संगठनों को साथ लेकर, “राष्ट्रीय पुरुष आयोग” का गठन करें जिससे प्रस्तावित क़ानूनों में महिला व पुरुषों का समान रूप से प्रतिनिधित्व हो सके|
जय हिंद, जय भारत !!!

समाचार रिपोर्टों एवं हमारे द्वारा कानून मंत्रालय के विधायी विभाग में फोन पर हुई बातचीत से यह संज्ञान में आया कि भारत सरकार एक नया कानून, विवाह (संशोधन) विधेयक पेश करने जा रही है और इस विधेयक के मसौदे के माध्यम से हिन्दू विवाह अधिनियम, 1955 एवं विशेष विवाह अधिनियम में संशोधन करना चाहती है।

इस पत्र के माध्यम से हम विवाह (संशोधन) विधेयक के लिये अपनाई गयी प्रक्रिया के विरुद्ध कड़ी आपत्ति दर्ज कराना चहते हैं।

इस पत्र के माध्यम से हम आपसे निवेदन करते हैं कि:

1. विवाह (संशोधन) विधेयक की प्रक्रिया को तत्काल रोकें, क्योंकि यह भारतीय लोकतंत्र में नागरिकों के मौलिक अधिकारों का उल्लंघन करता है।

2. विधेयक के मसौदे पर जनता की राय और प्रतिक्रिया के लिये एक ड्राफ्ट मसौदा प्रकाशित करें।

3. मसौदा तैयार करने की प्रक्रिया में हर पक्ष की हिस्सेदारी होनी चाहिये, अर्थात, अगर पुरुषों की ओर से कोई राष्ट्रीय पुरुष आयोग नहीं है तो महिलाओं की ओर से भी महिला कल्याण मंत्रालय या राष्ट्रीय महिला आयोग को भी भाग लेने की अनुमति नहीं होनी चाहिये।

4. पुरुषों के लिये काम करने वाले संगठनो को साथ लेकर ’राष्ट्रीय पुरुष आयोग’ के गठन की प्रक्रिया आरम्भ करें, ताकि कानूनों और कानून बनाने की प्रक्रिया के संदर्भ में, समाज में न्यायसंगत संतुलन वापस आ सके।

5. एक संसदीय समिति का गठन कर मसौदे पर पुनर्विचार करें और देखें कि क्या ऐसे किसी कानून की आवश्यकता है भी, क्या ये माननीय उच्चतम न्यायालय के दिशा निर्देशों के अनुसार है या केवल कुछ इच्छुक पुरुष-विरोधी पार्टियों के दबाव में ही बनाया जा रहा है।

    Very bad there should equality on both sides Why only women can take property of her husband…. Husband should also have the rights in the ancestral property of her wife so dat no body suffer during divorce… In present time not all girls are ablanaari..and not all boys are bad…. Why law is including family members of boys in 498a like mother father even married sisters…. Girls and their parents are also very greedy and misuse of 498a law is increasing day by day ….if any change is required exclude relatives of husband from dis false cases fight should be between husband and wife if they don’t want to live together den let them decide… Why properties are included between all dis… After taking property woman will again marry wid some other guy den again apply for divorce and take property from that guy also

    This site is biased, it is looking only at one side of coin…Trying to prove that All men in this world are good and women are bad. Think about those women who are really suffering due to greedy/criminal men and their families. This site wants to leave women helpless for ever…And men enjoy all good… According to this site..all laws should be in favor of men…Talibani thoughts…The site owner should be sent to Pakistan or Afghanistan. It is the right place for him.

      We have given logical points with data behind them. E.g. 85% of Indian divorces are filed by women. Now people can take that data and draw reasonable conclusions. That’s called data, linda ji.
