Excerpt :

A city court has ordered a man to pay maintenance of more than half of his monthly salary to his wife after divorce.

Manoj Rathi, who earns Rs 2,000 a month, was asked by Judge Vineeta Goyal to give his wife Rs 1,200 for the maintenance of their child after divorce on July 11.
Ironically, the wife, Nalini, earns Rs 9,000 per month, which is almost five times her husband’s salary.

Either the details are incorrect or it is miscarriage of justice. According to HMA 25 under which the judgment is done, either party husband or wife can claim maintenance from the other party after divorce.

    i have two baby my wife claim on me for the maintainance under section 125 but the problem is my father troubling with heart attack and my mother also troubling with father then what i do

      If I understand correctly, your parents are also dependent on you and you have expenses to bear for father’s healthcare. You can definitely show it as evidence in court to reduce maintenance.

      No details if wife is working or not. If not, children’s maintenance falls solely on your shoulders else it can be shared in proportion of husband’s and wife’s incomes. That’s the theory at least.

      “Mother troubling with father…”, you have to handle your family situations yourselves. I don’t think law is much use there. Without details, I don’t want to assume anything.
