Points on IPC 498A law, misuse, future PIL for Dowry Law Misuse etc.

18 Oct 2017 By videv 11 Comments

Note: This article is being put in public domain and can be used by anyone in part or full for any purpose whatsoever. Given recent news about revisit by Supreme Court of prior SC judgment of 27th Jul in Rajesh Sharma vs. State of UP, it has become imperative for men’s rights organisations to come up with their own arguments and get directly involved with the legal and judicial processes about how laws, their interpretation, and implementation are modified by judicial orders.  Even the revisit order by SC is based on a PIL by a women’s NGO comprising of women   …[Continue Reading]

What should be my stand in court?

23 Nov 2014 By videv 13 Comments

Hmmm… I find the question quite perplexing, when a man is facing a false 498a or DV (Domestic Violence) case or an unjustifiable demand for maintenance from wife: “what should be my stand in court?” How about: “I’m innocent!  Let the law take its course.” Apparently for 80-95% of Indian husbands, that’s too much complication.  They want to have a ‘stand’ which will achieve the following for them: If they are fearing IPC 498a, then anticipatory bail should be easy to get. (Note: after Jul 2014 SC judgment, it appears arrests have drastically come down so this concern should reduce)   …[Continue Reading]

Advice to men on 498a, maintenance, DV, divorce, child custody, what else

28 Sep 2014 By videv 87 Comments

A picture is worth a 1000 words, so we start our advice to men post with above picture.   Studying above picture for 5 minutes will give you as much benefit as reading the whole of Sun Tzu’s The Art of War, because you have most probably come here as a ‘victim of biased laws’, ‘harassed husband’, etc. etc. , and you are not a military general anyway; though one of these days one of them may also land up here!  I deliberately edited out the woman’s butt so you don’t spend the 5 minutes looking there Update history This is   …[Continue Reading]

A pathetic attempt to work around a pathetic law

5 Aug 2010 By videv Leave a Comment

There is  an Urdu saying: “marz badhta hi gaya, jyon jyon dawa ki”… “the malady continued to increase as more medicine was given”.  The recent direction by SC to law ministry seems to be  a step in same vain.  Since there is a sad excuse of a law called IPC 498a, where courts are unable to settle when parties want to settle, the law should be made compoundable.  The ex-CJI and current NHRC chief had also made a suggestion a few months back regarding rape law — that rape victims’ choice to marry the accused be respected.  What exactly were   …[Continue Reading]

The price of marriage is forever saying sorry to wife

5 Aug 2010 By videv Leave a Comment

The high court of Kolkata has taken over the mantle of sermonising the duties of a man towards his wife.  From previous year pronouncement of Justice Katju of SC — “do what your wife tells you and never question her authority”, to another pronouncement this year by Justice Deepak Verma of SC that “Whenever a person is married, there is no question of independence”. If the allegations against this cop are really true, then a sorry is not enough, and it is a fit case for criminal prosecution – under a relevant section of IPC.  But the judges seem to   …[Continue Reading]

Movie masala in dowry case, coming to a theatre near you

http://movies.indiatimes.com/news-gossip/news/Tina-Ambanis-Niece-Battered-For-Dowry/articleshow/6137952.cms The niece of one of India’s wealthiest women filed a complaint of dowry-related assault with the Gamdevi police last week. Mana met and married Arup Chatterjee, 44, in Delhi on November 27, 1996, after a brief courtship. According to her complaint, that was the start of all her troubles. She alleged that Arup wanted all the baratis to be ferried by a private airplane and also expected a Rolex, neither of which materialised. In the complaint, Mana added that Arup often hit her after getting drunk and even tried to kill her on several occasions. She further alleged   …[Continue Reading]

Being prosecuted is no bar for getting job as judge

8 Jun 2010 By videv Leave a Comment

All people facing prosecution and then facing problems in getting private jobs due to some overzealous (read stupid) HR departments can use this Mumbai HC judgment in their favour.  Sue the particular company for Rs 1 Crore at least for denying the job opportunity not based on merit, but on frivolous reasons. http://economictimes.indiatimes.com/news/politics/nation/Candidate-facing-prosecution-cant-be-denied-post-of-Judge-HC/articleshow/6019675.cms MUMBAI: In an important order, the Bombay High Court has held that a candidate who has been selected for the post of a Magistrate or a Judge cannot be denied the appointment merely because he is facing prosecution. “It cannot be laid down as a rule that   …[Continue Reading]
